Is CBD Legal In All 50 States?

There is often some confusion as to the legality of CBD in the 50 states of the United States. It is known that marijuana, part of the cannabis family, is not legal because it contains the psychotropic cannabinoid called THC. It is because of its psychotropic properties that it was designated as a Schedule I substance, and has been there for decades. However, CBD, also a cannabinoid, is not usually derived from marijuana plants but hemp plants that do not contain THC. Since CBD does not have psychotropic properties, is it actually legal?

How Is CBD Produced?

To answer this question, we must first look at how CBD is typically produced. Although it can be derived from a marijuana plant, there is always the possibility that some of the THC cannabinoids can be extracted at the same time. For example, if you were to extract CBD from a marijuana plant, upwards of one third of the cannabinoids that are extracted would be THC, whereas extracting it from a hemp plant, there is less than one third of a percent of THC on average. It would be impossible to experience psychotropic properties at all in these low amounts, but there are some states that say that any CBD product that has even a trace of THC would not be considered legal.

What States Are Marijuana Products Legal?

According to the voters of several states in the United States, marijuana is legal in many of them. That would include states like Oregon, Washington and California on the West Coast. It is also legal in Vermont, Massachusetts and Maine on the East Coast. Other states such as Colorado, Alaska, and Michigan are places that you can get marijuana, as well as the state of Nevada. Some of these states have had this designation for many years, whereas others are newcomers, all of which allow you to use marijuana recreationally.

Must You Get CBD From These States?

In general, you would be safer to purchase CBD products from these states since all marijuana related products are legal. However, that does not mean that you could not order from these states, on the Internet, and have it delivered to your home in whatever state you reside in. What you will have to be concerned about is being caught with CBD, and depending upon the judge and how they interpret the law, and the amount of THC that is found in your CBD, they could press charges if they wanted to. Until it is federally recognized as being legal, there is always this grey area where people that are not in the states that have been mentioned must have some concern when they are in possession of CBD products.

In conclusion, CBD is not legal in all 50 states. However, it is not illegal either. It just depends on the amount of THC that is in the CBD which can only be determined through laboratory testing. If you want to be safe, only use this and purchase it if you are in a state where marijuana itself has been legalized at the state level. Otherwise, since it does not contain THC, you are likely going to be safe when using this product because it does not contain high amounts of the substance that is actually banned by the federal government. One final note on this topic is that once it is legalized, it will really revolutionize the pharmaceutical industry. It is because of its ability to produce so many beneficial effects, there could be a very detrimental ripple effect that can change the way that people treat many common conditions that we suffer from today.
